Penny wasnt charged initially because they didnt have grounds to charge him, it was clearly legal self defense, ME admitted under oath she ruled cause of death solely from snippets of a phone video, didnt wait for toxicology. Penny was charged only because of an outcry, it was clear cut self defense by letter of the law, Penny was the only one charged when two passengers assisted him, was put on $2 million in bail (ludicrous sum) and when it was obvious manslaughter charge wasnt happening, a whole week of deliberations, they straight up dropped the charge and pushed the CNH on the Jury, extremely biased/kangaroo court.
