News 12/23/24 NY Arraignment Megathread

LM has pleaded not guilty to 11 charges in New York - video of his plea (at 1:12)
- One count of Murder in the first degree in furtherance of terrorism
- Two counts of Murder in the second degree (one as an act of terrorism)
- Two counts of Criminal Possession of a weapon in the second degree
- Four counts of Criminal Possession of a weapon in the third degree
- One count of Criminal Possession of a weapon in the fourth degree
- One count of Criminal Possession of a forged instrument in the second degree (source for charges)

- Judge Carro set LM's next court date for February 21, 2025 (state case)
- LM's next court appearance will be January 18, 2025 for his federal case.
- Bail was set at $1, but it is symbolic because he is being held in federal prison
- It appeared that LM did not have any family in attendance at this hearing
- Prosecutors said the amount of discovery material is voluminous, including thousands of hours of surveillance video
- Judge Carro said (in response to statements made below by KFA) that he has little control over what happens outside the courtroom, but can guarantee LM will receive a fair trial.

Statements made by LM's Attorney Karen Friedman Agnifilo:
- KFA: "We have two proceedings to that we have to answer to, one being death eligible, so we are requesting that we get immediate discovery of all the NYC police department, and FBI, and federal and state documents" - Judge Gregory Carro granted this.
- KFA: "I am very concerned about my client's right to a fair trial in this case. He is being prejudiced by some statements that are being made by government officials. Like every other defendant he is entitled to a presumption of innocence but unfortunately the way this has been handled so far, his rights are being violated."
- KFA: "There is a wealth of case law guaranteeing his right to a fair trial but none of the safeguards have put in place yet here. In fact it's just the opposite of what's been happening. He is a young man and he is being treated like a human ping pong ball between two warring jurisdictions here. These federal and state prosecutors are coordinating with one another at the expense of him. They have conflicting theories and indictments and they are literally treating him like he is a political fodder, like some sort of spectacle. He was on display for everyone to see on the biggest staged perp walk I've ever seen in my career. It was absolutely unnecessary, he has been cooperative with law enforcement, he has been in custody for over a week, he waived extradition, he was cooperative on all accounts. There was no reason NYPD and everybody to have these big assault rifles."
- KFA: "It was perfectly choreographed and what was the New York City Mayor doing at this press conference, your honor? That just made it utterly political."
- KFA: "And as your honor knows, under Lauro v Charles the Court of Appeals for the Second Circuit has held it to be clearly established that these staged perp walks to the media unrelated to a legitimate law enforcement objective is unconstitutional and I submit there was zero law enforcement objective to do that sort of perp walk. There is absolutely no need for that whatsoever."
- KFA: "And frankly, your honor, the Mayor should know more than anyone, the presumption of innocence that he too is afforded when dealing with his own issues and frankly I submit that he was just trying to detract from those issues by making a spectacle of Mr. Mangione."
- KFA: "I just want to put on the record statements that the Mayor made publicly about my client. Nothing saying alleged, for example. And he said I wanted to send a strong message with the Police Commissioner that we are leading from the front. I'm not going to just allow him to come into our city. I wanted to look him in the eye and state you carried out this terroristic act in my city, the city of New York that I love and he wanted to show symbolism. Your honor, he is not a symbol, he is somebody who is afforded the right to a fair trial. He is innocent until proven guilty."
- KFA: "We are going to fight these charges, whether it's in the state or federal to the fullest extent."

Staging 4-5 cops to stand directly over him is ridiculous. They won’t take their eyes off of him as if he’s a roided out supervillain. What a joke.

It's like they think he's gonna just fly away. It's ridiculous and just further showing L is not receiving a fair trial. They were legit hovering over him while he was talking to his attorneys, isn't that supposed to be privileged??

I hope those who doubt her abilities stop doubting her.
She displayed a tremendous amount of confidence when calling out the mayor and the federal government for their shenanigans.

Fuck yes.
I'm only a decade older than LM, but I'm a mother and my feelings towards him are very maternal and protective. As such, I am able to clearly recognize that Karen is experiencing those same feelings just from the way she interacts with LM. The way she put her hand on his shoulder before repeating the mayor's horrible words, as if to brace him, to make sure he knows she doesn't believe the things she's saying about him. I sighed a huge breath of relief after watching this video. She's got him. And she's not afraid to tell the truth. He is a human being. He is NOT a symbol. And that judge is gross. "I don't have a lot of control of what happens outside this courtroom". Why would you say that??? Ew.

I absolutely love it how he was turning his head to watch the prosecutor’s speech, deeply focused. Then he was also checking Karen’s notes. Scanning the audience on the back. He’s too intelligent to be intimidated by that circus.

I wanna share my own thoughts/questions on today's arraignment and see if anyone agrees or can potentially explain things further. (Also I'm going to avoid using *his* name here just in case Reddit flags it or something stupid).
- Did anyone see the vid of him walking in? I can't make out what was said but it looks like he was annoying the guy who was holding him to his left lol. I may have misheard but it sounded like the guy he was talking to in the walking video said something like 'don't disrespect me' and repeated it a few times lmfaoo.
- As well as that, when walking in today you could see him almost smirking (?) as he got near the cameras and then as he was passing it he looked directly into the camera and it felt so intentional - and considering the fact that his lawyers said he appreciates the support, I do lowkey think he did it for us ahhhh. He was very much giving nonchalant haha - and there's a pic of him smiling too which makes me so glad to see!
- Did anyone catch his reactions to Karen talking during the hearing? At one point she was basically talking about how insane the perp walk was and how she'd never seen anything like it and he instantly looked up at her like 'oh damn' lmfaoo. When mentioning the NY mayor's own federal charges he also looked up at her in a similar way haha.
- Does anybody have an idea what the picture Karen wanted the cops to take (I assume for him) at the end of the hearing was? He looked ready to take it with his hand outstretched for it til the cops said 'I don't know about that' and then she said 'okay...okay no worries, I asked' and then said something about 'it's Christmas'.
- The fact that he was so surrounded when walking in again and the cops standing behind him in court pissed me off so much tho, like he's not the 'terrorist' threat you're trying to portray him as please. And the shackles around his waist whenever he's walking makes me so mad omg, like the guy has back pain bffr.

- Not sure, but at one point a reporter asked him to say something and it looked like he shook his head no. I'm guessing his attorneys have advised him to not speak anymore. (You can see it a bit clearer here: https://www.tiktok.com/t/ZTYgs7LuB/)
- I don't know if I would classify it as smirking, he definitely seemed level-headed though and ready for what the day would bring!
- I loved that! I think Karen is a good choice and he seems confident in her abilities!
- I played that part in .25 speed, zoomed in and it looked like there were trees (based on the shape and color), but that's all I could get from it. Maybe it's a photo from somewhere he visited or someplace in Hawaii? Something to look at besides a concrete wall :( I am so curious though and hope someone can figure it out! I didn't hear the Christmas part, but I did hear her say Happy Holidays after they said no and he was being walked out by the agents in suits. Like why can't he have a photo?!? Inmates are allowed photographs.
- They continue to use him to make a statement that they are in control (which I hope backfires because they are not giving him a fair trial), but all I see is a bunch of cops that could be helping the citizens of NYC. Ya know, the people who are paying their paychecks. 🙄
I really hope they don't keep him in solitary until his next trial, it's almost a month out :/

As for 4) it's very hard for me to see but part of me was wondering if it's a photo someone close to LM sent to his lawyer to give to him since none of his family showed up in court? But you might be right too. Also he seemed like he was trying to play it cool but was actually disappointed/upset when they said no :(
And as for 5) fuck the cops and feds, they did NOT need so many of them surrounding him whilst walking or to have FOUR of them standing so close behind him in court and giving him death stares when he literally had his hands cuffed and chained to his waist. PISSING ME OFFFF

Probably! I feel like she would only bring him something from a close friend or family member. I agree, I think he was disappointed, but he seemed to play it off well as they have probably been doing lots of little things to get under his skin and make him feel less than.
And I'm pretty sure his ankle chains were still on so it's not like he's going to run very far! Complete overreach. It makes me mad, but at the same time they are only building Karen's case that he isn't receiving a fair trial.

I don't like how the media are portraying supporters as a fan base. I think it's sooooo important we all do our best to stay absolutely focused on the goal of Medicare for all. They are going to try so hard to discredit this movement and we can't let them.

In a way the propaganda of the mainstream corporate media exposes more of their dishonesty & nexus with corporate & political elites, which would actually anger people more. All their constant virtue signalling, out of touch takes, siding with corporate & politicians by downplaying the legalized corruption of healthcare, not giving voice to the millions who have been suffering debts, disabilities & deaths due to evils of healthcare system, it'll all work to their detriment and drive more people to the movement (although some sheep people lack even the least of critical thinking that they will follow them, but the again such people never would've joined the movement to begin with).

Can anyone explain some of the legal stuff here to someone not in the US? How can someone get three murder charges for one alleged murder? From vaguely following the Kyle Rittenhouse thing I thought he got off partly because he was charged with first degree murder, which meant he couldn't be found guilty of second degree? And these are just the state charges with the federal still to come at a separate hearing?

If they want to say that the response/support from people towards LM's alleged act indicates intent to make a political statement, that's not at all right, since LM couldn't predict what the public's response would be to his alleged act. If they want to say he evoked terror among the civilian population, that's kinda debatable because almost everyone in NY were continuing their daily life & even "celebrated" the event on December 4. Only those handful corrupt corporate elites can be said to be afraid, although even they carried out their jobs, I heard UHC even held the investors meeting that same day just a few hours after the incident. And as far as, coercion of government or government unit is concerned, then should we consider private corporates a part of government? [Since, there's no mention of specific intent to coerce he government (actually not even private corporates for that matter) with the alleged act on the alleged 'manifesto'] If they set such a precedence it'll only shine more light on the twisted hypocritical approach in governing of the state & administering law in relation to commers vs elite 1%. Moreover, making this alleged crime to be a terror act, sets even more questionable precedence in legal interpretations of similar crimes & rights of the people.
This terrorism charge is quite a foolish step by the prosecution & government who rushed to appease their corporate overlords without considering the possible counters, IMO.

i’m glad karen called the feds and the nyc mayor out on their bullshit. luigi is entitled to a fair trial and to be presumed innocent until proven guilty. if we look at how the cops treated dylan roof and bryan kohberger, the difference is like night and day. dylan who is a mass murderer even got to go on a little fast food break, meanwhile luigi got treated like he was the fucking joker. gimme a break. theyre using him as an example to send out a message to anyone who dares take a stand against oppressive corporations and theyre disgusting for that cause he doesn’t deserve it, especially when he hasnt even been given a chance to defend himself yet.
