Legitimate question, what do you think Elon could be convicted for in relation to the cyber truck?

Is it a POS for sure, but with the amount of protections that are given to corporations and the fact that as far as engineering wise he is probably only credited as a designer and likely the specific documentation signing away certain rights in order to purchase the cyber pos I highly doubt he ends up convicted of something.

I would more likely expect him to get hit by the EU for Twitter before he gets indicted by the US on anything.

Maybe now is a good time to remind everyone that Musk was likely an illegal immigrant himself.

He came to the U.S. on an F-1 visa in 1992 and attended UPenn. With very limited exceptions you are not allowed to work on an F-1 visa. Elon graduated from UPenn in 1995 (allegedly; his degrees were not awarded until 1997) and allegedly enrolled in Stanford in 1995, although the school has no record of him and he claims he left after two days. In any event, Musk stopped being a student in the fall of 1995, meaning his F-1 visa would have become invalid after 30 days.

In the meantime, Musk founded Zip2 on November 6, 1995.

So either Elon was working on an F-1 visa (not allowed) or his visa expired and he stayed in the U.S. working without legal status.

You can work on an F1 visa with OPT (I did it).

Not sure what the legislation was back then though.

Optional practical training (OPT) is temporary employment that is directly related to an F-1 student’s major area of study. Eligible students can apply to receive up to 12 months of OPT employment authorization before completing their academic studies (pre-completion) and/or after completing their academic studies (post-completion).

I don't think it's misinformation to speculate about Elon's former immigration status. As others have noted, the OPT program would have had only a tenuous connection to physics and economics and it was only started in 1992.

But there's also a video interview from 2013 of Elon and Kimball on which Kimbal says they were illegal immigrants. Elon tries to laughingly interject that it was "a grey area" before Kimbal sort of sush-es him and reaffirms that they were illegal.

I agree -- Illegal isn't just crimes. But I have encountered other lawyers who believe if incarceration isn't on the table, it isn't illegal.

Take the US flag code as an example. You cannot be punished criminally or civilly for not complying with it because of the 1st amendment, but it is still a law and not complying with it makes the counter action an "illegal" one.

Most cities do not enforce jaywalking (an actual crime) but they certainly could, just because it isn't enforced doesn't mean some pedestrian didn't commit an illegal act.

A person in the US who is here without permission, regardless if they overstayed a visa or crossed into the country without documentation has broken the law.

Keeping the documents concerning US nuclear and military secrets in the bathroom would have been concerning, but of far more concern are the folders that were found empty and the incidents we know of where he shared those secrets with people who had absolutely no legal right or need for them, and the fact that we have no idea who else he shared those secrets with who were more circumspect in receiving them. There's a significant chance that trump sold secrets to the enemies of America.

The thing that a lot of conservatives don’t get is that, in order for someone to apply for refugee status, they have to cross the international border of the country they want to apply in. That means crossing “illegally”/ without the proper paperwork. Because the paperwork process for applying for asylum can only be started once they’re IN the country.

Right. It's illegal to enter the U.S. without authorization. Simply being in the U.S. without authorization is a civil infraction. People who overstay their visas account for about 2/3 of undocumented immigrants.

I had this discussion with my brother-in-law. He said he believed that having your children taken away and maybe never seeing them again was an appropriate punishment for the grievous crime of entering the country without going through the official methods. I let him know that, at most, you'll probably only be cited for a misdemeanor for illegal entrance. It was only a few hours later he was talking about how he liked to illegally download movies from torrents. I asked if he thought that crime, which unlike seeking asylum in the US is an actual crime, should result in having his children taken away, and he thought my question ridiculous.

Seeking asylum at a port of entry is a legal way of entering the United States. 2/3 of the people crossing the border are asylum seekers.

Overstaying a visa or being in the US is a civil issue, not a criminal issue.

For the people who do enter the US under the radar, they may have committed a crime entering the country but, there isn’t a legal mechanism for a criminal conviction, instead the action the US takes to deport them is a civil action.

At that point, the use of the word “criminal” becomes a semantics debate. I have tried drugs, I once drove a car really fast on an empty road (not while trying drugs). I have once or twice in my younger years maybe have driven home from dinner after having a beer or two more than I should have. I would hardly consider myself a criminal… but I suppose one could argue that I am if they were being disingenuous.

Generally, criminals are people who perpetually break laws. People who wake up and break laws. A drug dealer is a criminal. The person who tries a drug once, is not.

Taking the semantics debate even further (and from a more legal angle and less from a social opinion of language application) one could argue that people only become criminals once they are convicted, as the constitution affords everyone the presumption of innocence until proven guilty. If you are not convicted of a crime, you’re technically still not a criminal, even if you’ve been accused of committing a crime. Constitutional rights extend to undocumented immigrants, therefore, they are legally not criminals unless they’re convicted to being here illegally, which they can’t be convicted for because it’s not a criminal matter.

As a state attorney general she knows that citizenship and immigration status are federal responsibilities. States are generally supposed to butt out.
